We reserve the right to modify these Terms at any time by posting an updated version on the Website. These changes do not affect rights and obligations that arose prior to the modifications. By continuing to use the Website after changes are posted, you agree to the revised Terms. It is your responsibility to review these Terms periodically. If you disagree with any provision or become dissatisfied with the Website, your sole remedy is to discontinue its use.

Terms and Definitions

“Business Day” – Any day when banks and governmental authorities in Czech Republic are open for business, excluding weekends and public holidays.

“Company” / “we” / “us” / “our” – Refers to Dzintrix Company S.R.O. and Tradestar Service Ltd, the service provider.

“User” / “you” / “your” – Refers to any individual using our Website.

“Website” – Refers to https://imagifity.com and its services, including generative AI solutions and digital content offerings.

“User-Generated Content” or “UGC” – Any content (artwork, visuals, etc.) created, generated, or uploaded by Users on the Website.

“Privacy Policy” – Refers to policies governing the processing of Personal Data, available on the Website.

“PiCoins” – An internal digital currency used exclusively within the Website for purchasing eligible products and services, as described in the “PiCoins Usage Terms” section below.

By using the Website, you agree to abide by these Terms, the Privacy Policy, and any related policies referenced herein. Services include image editing tools, templates, filters, and other generative AI features. We may update, modify, or discontinue any aspect of the Website or its services at our sole discretion.

Eligibility and Restrictions

To use the Website, you must:

We reserve the right to verify your eligibility and to suspend or terminate your access if eligibility requirements are not met.

Restricted Territories – Users from the following territories are not permitted to use our services: Afghanistan, Cuba, Iran, North Korea, Syria, Russian Federation, Belarus, Crimea, Donetsk, Luhansk, Myanmar, Central African Republic, China, Congo DR, Lebanon, Libya, Mali, Nicaragua, Somalia, Sudan, Venezuela, Yemen, Zimbabwe.

User Account

Purchases, Pricing, and Payments

Purchases – Digital products are purchased via our shopping cart system. We reserve the right to refuse orders prior to payment.

Pricing – Prices are displayed in Euros (EUR) and are subject to change. Price changes do not affect completed purchases.

Payment Methods – Payments must be made using approved methods listed on the Website. Unauthorized use of payment instruments is strictly prohibited. Cryptocurrencies, money orders, and personal checks are not accepted.

PiCoins Usage Terms

PiCoins are an internal virtual currency valid only within the Website and have no real-world monetary value outside the platform.

PiCoins may be purchased using approved payment methods or earned through special promotional activities announced by the Company.

PiCoins may be refunded to the User in monetary form at the same price at which they were purchased, provided they have not been used. Refunds will be issued to the same payment method originally used for the purchase.

PiCoins cannot be exchanged for other currencies and may only be used for products and services explicitly designated as available for PiCoin purchase.

The Company reserves the right to change the acquisition cost, redemption rate, or usage rules of PiCoins at any time without prior notice.

In the event of account closure or deletion (whether initiated by the User or due to a violation of the Terms), unused PiCoins will be refunded in monetary form at their original purchase price.

Payment Service Providers

Payments are processed by third-party providers. By making a payment, you authorize us to share transaction details with the provider.

Taxes

Users are responsible for applicable taxes unless otherwise stated during checkout.

Delivery Policy

Digital products are delivered to your account within 1–3 Business Days following successful payment. Delivery may be delayed due to technical or external issues beyond our control.

Cancellation and Refund Policies

Cancellations – Orders can be canceled before payment. Paid orders cannot be canceled, but refund requests are subject to the refund policy.

Refunds – Refunds may be issued for:

Payment errors (duplicate charges).
Missing promised features in a purchased product.

Refunds are not issued for dissatisfaction or change of mind. Refund requests must be made within 14 days of purchase and include supporting documentation. Approved refunds will be processed using the original payment method within 15 Business Days.

Refunds for PiCoins – PiCoins may be refunded to the User in monetary form at the same price at which they were purchased, provided they have not been used. Refunds will be made to the original payment method within 15 Business Days after the request is approved.

User-Generated Content (UGC)

Users retain ownership of UGC but grant Imagifity a non-exclusive, worldwide license to use it for improving services. Users are responsible for ensuring their UGC does not infringe third-party rights. Imagifity reserves the right to remove inappropriate UGC without notice.

Prohibited Actions

Users may not:

Use the Website unlawfully or violate third-party rights.
Access restricted areas or exceed authorized permissions.
Interfere with Website functionality or security.
Exploit UGC for unauthorized purposes.
Engage in spam, data mining, or reverse engineering.

Intellectual Property

All Website content, including software, images, and text, is protected under copyright laws. Unauthorized use, reproduction, or distribution of this content is prohibited.

Disclaimer and Limitation of Liability

Imagifity provides services “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from the use of the Website.

Governing Law and Disputes

These Terms are governed by the laws of Czech Republic. Disputes will be resolved in the courts of Praha, Czech Republic.
